The terms of using Rukata.

Rukata runs a marketplace where sellers list things they own and buyers buy them. We are not the seller and we never own the items. The seller is responsible for the item, how it is described, and shipping it. We provide the site, the checkout, and buyer protection.

You must be at least 18 and able to enter a contract. Keep your login secure. You are responsible for activity on your account. We may suspend or close an account that breaks these terms or the law.

You may not list, buy, or sell anything banned or illegal. Our selling rules contain the full list. We can take down any listing or content, and hold any payout tied to it, at our discretion.

Prices, availability, and price drops can change until you check out. When you buy, you agree to pay the total shown. Your card is authorized at checkout and charged once the seller confirms the item is ready to ship. Ownership of the item passes from the seller to you.

We hold your money until the item arrives. If an order never shows up or is not what was described, you can ask for a refund under our buyer-protection reasons. Changing your mind is not covered. Our buyer-protection rules for refunds and returns are part of these terms.

You may list only new or open-box products you own and are allowed to resell. Describe the condition honestly, use real photos of the actual item, and send proof when we ask. After a sale, ship on time with tracking. Your listings have to be accurate and you have to deliver what you sold. We show your plan, your selling fee, and when you get paid before you publish.

We charge the selling fee shown on your plan, taken from the item price, plus payment processing at cost. We pay the seller after the item arrives and after any hold that applies. You will see your fees and plan terms before choosing or paying.

You owe the income tax on what you sell, and you have to report your earnings where the law says so. When sales tax applies to an order, it is shown at checkout. Depending on where the sale happens, the law decides whether we collect and send that tax or the seller does. If your sales reach the point where we have to report them, we will ask you for your tax details.

Sellers may list only items and photos they own or are allowed to use. Copyright and brand owners can report listings that break their rights by contacting us. We take down material that breaks those rights, and we close the account of anyone who does it more than once.

Rukata is provided "as is" and "as available," with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the site will always be up, error-free, or secure. Sellers sell the items, not Rukata.

To the fullest extent allowed by law, Rukata is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, that come from your use of the site. For any claim, the most we owe you is the fees you paid us in the three months before the claim, or one hundred dollars, whichever is greater.

If your listings, your buying or selling, or your breaking of these terms or the law causes a claim against Rukata, you agree to cover the claims, losses, and costs that come with it.

California law governs these terms, without regard to its conflict-of-law rules. Any dispute goes to binding individual arbitration in California. You and Rukata both give up the right to a jury trial and the right to join a class action, except where the law does not allow that. You can opt out of arbitration by emailing us within 30 days of first accepting these terms.
